BOOKEASY TERMS & CONDITIONS

By using this Site or any of Our services you agree to comply with and be legally bound by these Terms.

 

Scope of Service

Bookeasy provides an online platform to facilitate bookings of accommodation, tours, activities and associated services with third party Operators. By making a booking via Bookeasy you enter into a direct (legally binding) contractual relationship with the Operator of the accommodation and/or services that you choose. All Bookings are subject to the Operators terms and conditions, which should be read in conjunction with these Terms. Our role is limited to facilitating Bookings with the Operator. The accuracy of accommodation, availability & pricing information on our Site is the sole responsibility of the Operator. Whilst all efforts are made to ensure that the information remains correct, we cannot be held responsible for any errors or omissions.

 

Customer Obligations

You must be at least 18 years of age to make a Booking via Bookeasy. You understand that the advice provided on Bookeasy is general in nature and that any clarifications, special requests or requirements that are important for your Booking should be confirmed directly with the Operator. You are solely responsible for deciding whether a destination, accommodation or associated service is suitable for your needs.

 

Pricing & Fees

Entering your travel dates and the correct number of passenger types (adults, children & infants, etc.) on the accommodation and/or service listing will display availability and per night rates for each room type during your selected dates. These rates are provided in Australian dollars. Rates are exclusive of fees, but inclusive of GST (where applicable) and all other taxes unless specified otherwise. Prices for ‘on request’ bookings are provided as a guideline only and any variances in pricing will be provided by Bookeasy upon confirmation of availability. A booking fee of 1% is added to all confirmed bookings. Any additional fees charged by the Operator will be advised during the booking process. Bookeasy is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on any of the Booking elements to the relevant tax authorities. Online bookings with a $0 (free) displayed anywhere in the booking will not be honoured.

 

Confirmation of Bookings

You may receive a confirmation of availability via our website for your selected accommodation and/or tour, however your Booking will not be fully confirmed until your full payment has been received. Bookeasy reserves the right to cancel your Booking if payment details are not provided, if payment details are incorrect or invalid, or if payments are not made according to the stated payment terms.

 

Payments

Full payment is due at time of booking on all confirmed reservations. Deposit conditions for certain accommodation and/or tour products may vary and we will advise you of these conditions and request your consent prior to proceeding with the booking.  All Bookings will be charged in Australian dollars, and depending on your credit card’s currency and country in which your card was issued, your credit card provider may impose foreign exchange fees and other fees which are in accordance with your arrangements with that credit card provider.

 

Changes & Cancellations

Cancellation of confirmed bookings will attract an AUD $25.00 (inc GST) charge.  This Administration Cancellation Fee is in addition to any advertised Cancellation Fee the Operator may have. Booking fees are non-refundable. Change and cancellation terms vary by Operator and will be advised during the Booking process. Please note that Bookings at certain accommodations, tours or activities, or in certain time periods, for certain accommodation room types, tour or activity products cannot be cancelled or changed, and where changes or cancellations are permitted, fees may apply. We are unable to assist with disputes relating to the Operator’s Booking terms and recommend comprehensive travel insurance to protect against unforeseen changes.

 

Requirements at Check-in

You may be required to produce a valid photo ID to check-in at some accommodation properties. You may also be required to provide a credit card imprint or a refundable security deposit upon check-in. Some Operators may have additional requirements that will be advised upon Booking.

 

Feedback & Complaints

Feedback and complaints relating to accommodation, tours, activities and associated services should be addressed immediately with the Operator. Where necessary, a follow up written complaint should be sent directly to the Operator within 7 days. In the event of any grievance or complaint leading to a dispute between you and the Operator, Bookeasy will not act on behalf of you or the Operator.

Images & text throughout the Site is copyright protected. Images are used with permission and may not be reproduced, copied, transmitted, or manipulated without the written permission of the respective copyright holders. Copyright belongs to the individual Operators and the following Tourism Bodies; Tourism Australia, Tourism New Zealand, Visions of Victoria, Destination NSW, Tourism and Events Queensland, Tourism Tasmania, Tourism South Australia, Tourism Western Australia, Tourism NT.

The Site may contain links to third party websites or resources. We do not endorse and nor are we responsible or liable for the reliability, availability or accuracy of such websites. Some parts of the Site use additional third-party services such as Facebook Login or Google Maps. Your use of these services is subject to the respective terms and conditions of each service.

 

Changes to these Terms

These terms may be updated or changed at any time without prior notice. Changes will be posted on our Site. By continuing to use the Site you are indicating that you agree to be bound by the modified Terms.

 

Liability

Without exclusion or limitation of your statutory consumer rights, we will not be liable for any losses, damages, liability, claim or expense (howsoever caused, including negligence, and whether direct, indirect or consequential) arising from the use of or connected with our Site or any accommodation or services Booked via our Site. We make no warranty or representation as to the fitness or suitability of any product or service displayed on our Site or any linked site. We exclude all conditions and warranties relating to the site and the associated third party booking engine. In particular, we do not make any representations or warranties that the site will be uninterrupted or error free. Where our liability cannot be excluded, to the extent permitted by law such liability is limited to the value of the Booking made. You acknowledge that you will be liable for any illegal, improper, inappropriate or defamatory material which you may post to the Site and you will indemnify Bookeasy and it's Operators from any claim, demand or loss arising out of your breach of this agreement, your violation of the law or the rights of a third party, or your use of this Site.

 

Provisions

If any provision of this Agreement is or becomes invalid or non- binding, the Parties shall remain bound by all other provisions.

 

Governing Law

This agreement will be governed, construed, and enforced in accordance with the laws of Queensland, Australia.

 

Key Terms

"Bookeasy", "we", "us" or "our" means Bookeasy, owned and operated by Bookeasy Pty Ltd (ACN 122 744 209)

"Operator" means the owner or manager of the accommodation or experience

"Terms" means these Terms & Conditions.

"Booking" is when you have received confirmation of your booking request from the Operator

"On Request" means confirmation will be usually be provided by the Operator within 1 business day
