TERMS AND CONDITIONS - LAURA THE EXPLORER ADVENTURE TOURS
Laura the Explorer Adventure Tours requests that you read the following Terms and Conditions before booking one of our Tours.
The terms "we", "us", and "our" refer to Laura the Explorer, and "you," "your," "their," "they," and "participant" refer to the customer.
By booking a tour with Laura the Explorer Adventure Tours, you are agreeing to the following terms and conditions:
1. PAYMENT AND DOCUMENTATION
• The Booking Form must be completed accurately, including all
medical, dietary requirements, or other information that is
relevant for the Tour.
• Booking requests are made subject to availability.
Confirmation of your booking will be sent once final payment
has been made.
• Prices quoted are per person.
• Tour prices and these Terms and Conditions are subject to
change at any time at our discretion.
2. ITINERARIES AND DESCRIPTIONS
• We reserve the right to change the itinerary and/or substitute
any routes, vehicle types or activities for any reason, including
but not limited to safety, weather, or other unforeseen
circumstances.
• We reserves the right to change, at any time, the tour guide. If
that happens, LTE will try to ensure that the alternative tour
leader or escort has expertise commensurate with that of the
original tour leader or escort. Any such change to LTE will not
give rise to any right on your part to cancel the tour or claim any
expenses, loss, or damage which may be suffered.
• We cannot guarantee pick-up and drop-off times; however, all
efforts are taken to provide the best experience possible for
each passenger.
• We are not responsible for any additional expenses incurred by
participants as a result of changes to the itinerary or other
unforeseen circumstances.
3. DURING THE TOUR
• We reserve the right to terminate the participation of any
participant who does not comply with these Terms and
Conditions or who engages in behaviour that is detrimental to
the safety or enjoyment of other participants. Our primary
consideration is the safety of all passengers, staff, and people
we come into contact with during our Tours.
• Participants are responsible for their own personal belongings
and equipment, and we are not liable for any lost, stolen, or
damaged items.
• Participants must follow all safety instructions provided by the
tour operator and its staff and must not engage in any activities
that may be dangerous or harmful to themselves or others.
• Participants must respect the local flora and fauna and adhere
to all state/federal laws as well as national and local park
regulations.
• Participants must not be under the influence of alcohol or drugs
during the Tour. Adults may consume alcohol after the cycling
portion of the Tour is complete.
• Participants acknowledge that cycling, swimming, and
snorkelling, can be inherently dangerous activities. You
recognise that there are risks and hazards specifically
associated with these activities, including the possibility of injury
and death and loss and damage both to yourself and your
possessions.
• You must not damage any equipment provided to you on Tour
and you shall compensate Laura the Explorer for the cost of
repair or replacement for any damage howsoever caused to the
equipment.
• You shall take the equipment in the condition in which it was at
the commencement of the hire, and Laura the Explorer shall not
be responsible for any defects in the equipment and does not
warrant that the equipment is suitable for the particular or any
purpose for which it is to be required. To the extent permitted
by law, all conditions, warranties, and representations whether
expressed or implied in favour of participants are hereby
excluded.
4. HEALTH AND FITNESS
• You must not embark on a Tour if you have any medical
condition, mental health condition, injury, illness, contagious
disease, or any other condition that would impact your ability to
participate in group activities safely, or which would put at risk
the safety and well-being of other passengers.
• Participants must be in good physical health and capable of
participating in the activities included in the tour, such as
cycling and walking. We will not be held responsible for any
injuries, health issues, or other medical conditions that may
occur during the Tour.
• If you suffer from severe muscular, chest, heart, sight, hearing,
or bronchial disorders, or if you are a severe asthmatic, or have
high blood pressure, you are strongly advised against
participating.
• While we do not discriminate by age, please carefully consider
your ability to participate in a 10km cycle tour. We reserve the
right, in its absolute discretion, to refuse a participant the right
to participate in a tour.
• You declare and warrant that:
o You are in good health and mental and physical fitness at
the time of booking the Tour and on the day of the Tour.
o You have disclosed every matter concerning your health
and mental and physical fitness of which you are aware
that is relevant to our decision to permit you to go on the
Tour.
o You will notify us immediately upon any adverse change
in your health or fitness that may be likely to affect our
decision to permit you to go on the Tour.
• We highly recommend that you have personal travel and
medical insurance that provides you with the best cover for your
own personal circumstances.
• Participants are responsible for their own medical insurance
and medical expenses.
• Participants agree that Laura the Explorer may arrange
appropriate first aid and/or medical treatment at my expense if I
get sick or injured on Tour.
5. CANCELLATIONS AND REFUNDS
• All tickets and bookings are non-refundable. Provided that
notification is received by Laura the Explorer over 24 hours
prior to the scheduled departure date/time, the amount paid for
any unused ticket/service can be issued as a credit note for
future Laura the Explorer Tours. Notification must be made by
phone or email.
• Any amendments/changes made within 24 hour of scheduled
departure time will result in the forfeiture of all monies.
• Refunds will not be made for inadvertently booking the wrong
tour time, departure point, or for personal reasons.
• Cancellations once the scheduled tour has been undertaken
will result in the forfeiture of all monies.
• Credit notes are valid for a period of one (1) year from the date
of scheduled travel. No extensions can be offered on credit
notes.
• Credit card surcharge, bookies fees and postage and handling
fees cannot be refunded or credited.
• Redemption of a credit voucher can only be made when
booking via phone or email.
• Unused portions of a credit note will be re-credited. Any unused
portion of a credit note will have the same expiry date as the
original.
• For any tour cancellations due to reasons entirely outside of
passengers' control, passengers will be offered:
• To transfer to a Tour on a different date; or
• A full refund (minus surcharges, booking fees and postage and
handling fees).
• All cancellations or requests to transfer must be made in writing
to info@lauratheexplorer.com.au.
• If you fail to join a tour or leave before its completion, you will
not receive a refund for unused services.
6. GENERAL
• Image consent: I agree that Laura the Explorer, the Rottnest
Island Authority, or anyone on their behalf may take photos and
videos of me during the tour, that I won’t own this material and
that Laura the Explorer and Rottnest Island Authority may
choose to use the material for promotional or other purposes
without my further consent being obtained.
• Release: For myself, my executors, administrators, heirs, nextof-kin, successors and assigns, I hereby waive and release all
claims I may have against Laura the Explorer including any or
all claims for injury, loss or damages caused by negligence
arising out of my participation in the Laura the Explorer tour,
together with any costs including legal fees that may be
incurred as a result of such claim whether valid or not.
• Jurisdiction: These terms are made under the exclusive
jurisdiction of the laws of Western Australia and if were to make
a claim in relation to the Tour, it would be subject to the laws of
Western Australia.
