Cancellation Policy
Busselton Walking Tours – Terms &
Conditions
These Terms & Conditions apply to all bookings and participation in tours operated by Busselton
Walking Tours (“we”, “us”, “our”). By making a booking or joining a tour, you agree to these terms.
1. Bookings & Payment
1.1 How to book
Bookings must be made either:
● through our online booking system (such as Acuity Scheduling), or
● in writing via email or text message directly with Busselton Walking Tours.
1.2 Payment
● All tours must be paid for at the time of booking, unless other arrangements have been
agreed in advance with Busselton Walking Tours.
● Your booking is not confirmed until full payment (or agreed alternative) has been received.
1.3 Proof of purchase
● All tour participants must be able to produce proof of purchase for the tour (for example, a
booking confirmation email or digital ticket).
● A paper copy is not required; digital evidence on a phone or device is sufficient.
● Participation in the tour may be refused if proof of purchase cannot be shown.
2. Cancellations & Refunds
2.1 Cancellations by the tour participant
● Cancellations must be made by contacting Busselton Walking Tours:

○ or by phone/text: 0435 089 214
More than 7 days before the tour:
● If you cancel more than 7 days prior to your selected tour date, you are entitled to a full
refund.
Between 7 days and 24 hours before the tour:
● If you cancel between 7 days and 24 hours prior to your selected tour date, you are entitled
to either:
○ a 50% refund, or
○ the option to transfer your ticket to another tour on a different date (subject to
availability).
Within 24 hours of the tour:
● If you cancel within 24 hours of your selected tour date, no refund will be provided and no
change of tour date will be offered.
2.2 Cancellations by Busselton Walking Tours
● The tour will not proceed if Busselton Walking Tours decides that:
○ the weather makes participation unsafe, or
○ any other circumstance (at our absolute discretion) makes it inappropriate or unsafe
to run the tour.
● If a tour must be cancelled by Busselton Walking Tours for weather or any other reason, you
will be offered:
○ a full refund, or
○ the option to transfer your booking to a new date (subject to availability).
2.3 Force majeure
● If a tour has to be cancelled due to a force majeure event (an event outside the control of
the parties, e.g. floods, cyclones, natural disasters, acts of God), not including COVID-19,
you will be offered:
○ a full refund, or
○ a change of date, or
○ a credit to be used for a future tour.
3. On the Tour
3.1 Tour changes
● Busselton Walking Tours reserves the right to add, withdraw, substitute and/or vary advertised
routes, inclusions, prices and departure times without notice.
● Reasonable efforts will be made to maintain arrangements as advertised, but we may need to
modify the tour due to weather, safety, access, or other operational reasons.
3.2 Medical conditions & fitness
● All tour participants are required to disclose to the Busselton Walking Tours guide, before the
tour begins, any medical condition that may affect their ability to safely undertake the tour.
This includes, but is not limited to:
○ epilepsy
○ dizziness or balance issues
○ limb or back injury
○ angina or other heart conditions
○ severe or uncontrolled asthma
○ visual impairment
○ depression or other mental health conditions that may be relevant
○ recovery from recent surgery
● By joining the tour, you acknowledge that you are responsible for assessing your own fitness
and health suitability to participate.
3.3 Assumption of risk
● The tour participant acknowledges and agrees that they participate in the Busselton Walking
Tours tour at their own risk.
3.4 Right to refuse participation
● Busselton Walking Tours reserves the right to refuse any person from participating in a tour,
for any reason, in its absolute discretion, whether or not they have previously purchased a
ticket.
● No refund will be provided where a participant is refused or removed due to their own
behaviour (see Conditions of Admission below).
3.5 Conduct on tour
● During the tour, all participants must:
○ obey the directions and instructions of the Busselton Walking Tours guide;
○ behave in a way that does not disturb other participants;
○ not interfere with the guide’s ability to conduct the tour in a safe and enjoyable
manner.
3.6 Photography and media
● All tour participants acknowledge and agree that Busselton Walking Tours is expressly
authorised to take photographs of participants during the tour and to use such photographs in
any manner Busselton Walking Tours sees fit, including but not limited to:
○ advertising and promotional material
○ the Busselton Walking Tours website
○ social media platforms such as Facebook and Instagram
○ other digital or printed media
● If you have concerns about your image being used, please speak with the guide before the
tour begins. We will make reasonable efforts to accommodate your request where possible.
4. Insurance & Liability
4.1 Public liability insurance
● Busselton Walking Tours holds public liability insurance cover of $20,000,000.
4.2 Exclusion of liability – loss, damage or injury
● Busselton Walking Tours excludes liability and will not be responsible for any loss, damage
or injury arising from or connected with the tour, no matter how that loss, damage or
injury is caused, except where such liability cannot be excluded under Australian law.
4.3 Delays and interruptions
● Busselton Walking Tours excludes liability and will not be responsible for any loss, damage
or inconvenience arising from or incidental to any delay in the scheduled tour taking place.
4.4 Alcohol consumption
● Busselton Walking Tours does not allow the consumption of alcohol whilst on any Busselton
Walking Tours tours.
● Drunken or unruly behaviour will not be tolerated at any time during the tour.
● Busselton Walking Tours and its guides reserve the right, at their complete discretion, to:
○ refuse participation onto any tour should the guide believe the participant is under the
influence of alcohol or drugs; and/or
○ refuse continued participation in the tour where alcohol-related behaviour is unsafe,
disruptive or offensive.
● Busselton Walking Tours excludes liability and will not be responsible for any loss, damage,
injury or other incident during or after the tour related to the consumption of alcohol by tour
participants.
5. Conditions of Admission
5.1 Right to refuse entry
Busselton Walking Tours reserves the right to refuse tour participants onto the tour in reasonable
circumstances, including but not limited to:
● health and safety concerns
● licensing or regulatory requirements
● where a booking is void, invalid or cannot be produced
5.2 Right to remove participants from the tour
Busselton Walking Tours also reserves the right to request that tour participants leave a tour at any
point on reasonable grounds and may take any appropriate action to enforce this right.
By way of example, the tour guide may remove a participant who:
1. has behaved in a manner which, in the reasonable opinion of the guide, has or is likely to
affect the enjoyment of other participants; or
2. uses threatening, abusive or insulting words or behaviour, or behaves in a manner which may
provoke a breach of the peace; or
3. in the reasonable opinion of the guide, is acting under the influence of alcohol or drugs; or
4. fails, when required, to produce proof of identity or age (for example, where age restrictions
apply in licensed venues).
5.3 Compliance with instructions
● You must comply with all instructions and directions given by the tour guide.
5.4 No refunds in case of removal for behaviour
● No refunds will be given to tour participants who are refused entry to, or ejected from, a tour
due to their own behaviour as described above (and similar conduct).
6. Gift Vouchers
6.1 Purchase & payment
● Gift vouchers must be paid for in full at the time of purchase.
● An electronic copy of the gift voucher will be emailed to the purchaser.
6.2 Type and use
● Gift vouchers may be sold:
○ for a specific Busselton Walking Tours tour, or
○ for a specified monetary amount.
● Gift vouchers are non-refundable, but the value of the voucher is transferable between
tours, subject to availability and any price differences at the time of booking.
6.3 Restrictions
● Gift vouchers must not be resold or used for any commercial purpose without prior written
permission from Busselton Walking Tours.
6.4 Validity
● Gift vouchers are valid for three (3) years from the date of purchase.
● The voucher must be redeemed by making a booking within the three-year period, but
the actual tour date may fall after this period, provided the booking itself was made before the
voucher expiry.
7. General
● Busselton Walking Tours may update or amend these Terms & Conditions from time to time.
The version applicable to your booking will be the version in place at the time you made the
booking.
● If any part of these Terms & Conditions is found to be invalid or unenforceable, the remaining
provisions will continue to apply.
